GASP of Colorado (Group to Alleviate Smoking Pollution)

Some local laws have provisions that are stronger than the Colorado Clean Indoor Air Act and provide better protection from exposure to secondhand smoke at work and in public places. GASP of Colorado rates local laws compared to the state law on a scale of zero to five.  The highest and best rating is a five (click here for an explanation of our rating system).  Any stronger provisions in the state law take precedence over any weaker local provisions so the state law should be reviewed first through these links: smokefreecolorado.org or gaspforair.org.

                          

This local law provides more protection from secondhand smoke than the state law in the following area(s):

A RESOLUTION PROHIBITING SMOKING
IN ALL COUNTY FACILITIES AND VEHICLES

WHEREAS, numerous studies have shown that second hand smoke creates a myriad of health problems among non-smokers and is the third leading cause of preventable death in the United States, and,

WHEREAS, as the majority of our citizens and employees have chosen not to smoke and should not be subjected to second hand smoke in public facilities and vehicles or in the work place, and,

WHEREAS, it is not the intent of the Board of County Commissioners to prevent responsible adults from smoking legal substances if they choose to do so, and,

WHEREAS, those individual employees who choose to smoke should be given the opportunity by their respective supervisors to use these items in a reasonable manner outside of enclosed facilities or vehicles, and,

WHEREAS, the Board of County Commissioners has determined that it is in the best interests of the health, safety, and welfare of the citizens of Hinsdale County to not allow smoking within county facilities or vehicles except in certain circumstances.

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Hinsdale County, Colorado:

1. All forms of smoking are prohibited by any person in all county owned, leased, operated or maintained buildings, effective this date

2. With the permission of their supervisor, individuals may smoke in their vehicles only when they are traveling alone. Smoking in county vehicles is not allowed when carrying passengers.

3. County supervisors will provide a reasonable opportunity for their employees who wish to smoke legal substances in a safe and responsible manner.

4. The provisions of this resolution shall be included in the county personnel policy.
